Given the lack of historical evidence, it is unknown how authorities and courts would react to a
real foreign arbitral award.
Germany does not have a bilateral investment treaty with the United States; however, a
Friendship, Commerce and Navigation (FCN) treaty dating from 1956 remains in force.
Currently, USTR and the European Commission’s Directorate-General for Trade are negotiating
a Transatlantic Trade and Investment Partnership including an investment chapter.
Book 10 of the German Code of Civil Procedure is on arbitration proceedings.
Germany has a domestic arbitration body called German Institution for Dispute Settlement. The International
Chamber of Commerce has an office in Berlin. In addition, chambers of commerce and industry
offer arbitration services.
