Tax losses which cannot be offset in the current year
Tax losses which cannot be offset in the current year may be
carried back one year up to an amount of € 1,000,000 for corpo-
rate income tax purposes. To the extent that the losses exceed
€ 1,000,000 or cannot be fully offset against the previous year’s
income, they may be carried forward indefinitely.
However
losses carried forward may be offset without restriction against
profts only up to an amount of € 1m. Losses carried forward in
excess of this amount may be offset against no more than 60%
of taxable income in the current period (so called “minimum taxa-
tion”). The taxpayer can elect whether to carry back the losses or
not and may also decide, within the limits described above, the
amount to be carried back.
